The Appeal Court sitting in Sokoto has on Monday sentenced one Sani Ibrahim to life Imprisonment for having carnal knowledge of two Qur’anic School Pupils in the Sokoto metropolis.
The presiding judge, Justice Ibiowei Tobi, during the court proceedings, said that based on the general principle of law, pieces of evidence, and testimonies of PW 1 and the PW2 and PW3 who were victims of the offence, the court was satisfied beyond reasonable doubt that the offence was committed.
According to him, PW2 has confessed to the Court that Sani Ibrahim has unzipped him while sleeping in the room at their Qur’anic School and had Anal intercourse with him twice, and PW3 also in his confession before the lower court revealed that the Appellant had on three occasions had Anal intercourse with him while sleeping at the same vicinity with the other victim the PW 2.
Justice Tobi, however, in his judgment, set aside the earlier of the lower court which discredited all the pieces of evidence and testimonies granted by PW1, PW2, and PW3 and passed judgment in favour of the accused.
The lower court at its judgment dismissed the evidence from PW1 which the judge says was a heresy while evidence from PW2 and PW3 was not attached or substantiated by a sworn court affidavit.
“The lower court owed to convict the accused in the first instance as shreds of evidence from PW1, PW2, and PW3 are enough to corroborate one another and sentence the offender.
“The accused his confessional statement admitted that he used to have canal intercourse but not with the victims, PW2 and PW3 as alleged.
“Gone are the days when defence counsel will confuse people,” Justice Tobi said.
How could the accused confess to committing a crime before a Court of law and later be set free, asked Justice Tobi.
“The convict Sani Ibrahim is an Animal who doesn’t deserve to be amid human beings,” Justice Tobi said.
He said based on all the shreds of evidence and confessional statements available before the court, ” The court is convinced beyond reasonable doubt that, the accused has committed the offence and therefore sentenced him to life imprisonment.
