A Federal High Court in Abuja has declined to grant an interim injunction sought by some members of the Peoples Democratic Party (PDP) to stop the party’s forthcoming National Executive Committee (NEC) meeting and national convention.
The suit was filed by Austine Nwachukwu, chairman of the PDP in Imo State; Amah Abraham Nnanna, chairman of the Abia chapter; and Turnah George, the party’s South-South secretary — all believed to be allies of the Minister of the Federal Capital Territory (FCT), Nyesom Wike.
The trio had approached the court seeking to restrain the PDP from proceeding with its NEC meeting scheduled for October 18 and its national convention slated for November 15–16.
However, Justice James Omotosho rejected their ex parte motion, refusing to issue an interim order against the PDP and the Independent National Electoral Commission (INEC). The judge ruled that all parties must first be served with the motion on notice for an interlocutory injunction.
In the suit, marked FHC/ABJ/CS/2120/2025, the plaintiffs asked the court to:
– Prevent the PDP from holding meetings, congresses, or conventions without due notice and democratic procedures;
– Stop INEC from attending or monitoring PDP’s leadership meetings; and
– Restrain INEC from acting on any 21-day notice issued by PDP officials regarding the convention.
They also sought to stop the PDP from holding any leadership meetings, including those scheduled for October 15, pending the determination of the main suit.
Although the court refused the interim request, Justice Omotosho cautioned all parties against taking any steps that could prejudice the outcome of the case.
“Any step or decision that renders the court’s eventual ruling ineffective will be considered null and void,” the judge warned.
The matter was adjourned to October 14 for the hearing of the motion on notice.
