Over 50 states, including Egypt and France, are set to present arguments until February 26 in the International Criminal Court (ICJ) to review Israel’s occupation of the West Bank, Gaza, and East Jerusalem.

Palestinian representatives have requested that the judges declare Israel’s occupation illegal, arguing that it could help reach a two-state solution. Ten states, including South Africa, have criticized Israel’s conduct in the occupied territories, with many urging the court to declare the occupation illegal.

The recent surge of violence in Gaza following Hamas’ attacks on Israel has complicated Middle East grievances and damaged efforts towards peace.

The judges are expected to issue their opinion within six months, considering the legal status of the occupation and its consequences for states.

Israel ignored a 2004 World Court opinion when it found Israel’s separation wall in the West Bank violated international law. The current hearings could increase political pressure over Israel’s war in Gaza, which has killed around 29,000 Palestinians since Hamas attacked Israel on October 7.

Israel captured the West Bank, Gaza, and East Jerusalem in the 1967 conflict.
