Culpable homicide: Court Sentences Man to Death by Hanging in Kebbi

Kebbi – High Court ‘One’ in Birnin Kebbi has sentenced a 25 yrs old man Sulaiman Idris, a citizen of the Niger Republic to death by hanging for culpable homicide.

It could be recalled that Idris Sulaiman was paraded by the police to have killed a woman with a cutlass in her bedroom alongside her two-year-old daughter who hit her head on the tiles floor in Labana area of Birnin Kebbi on the 11th of April 2022.

The State Counsels arraigned and charged Sulaiman with a two-count charge of culpable homicide, punishable with death under Section 191(a) and (b) of Kebbi State Penal Code Law, 2021.

Delivering Judgment, Justice Sulaiman Muhamma-Ambursa, said that the prosecution had successfully proved their case beyond a reasonable doubt before the court.

“In considering the weight and unchallenged evidence tendered by the prosecution counsel before the court.

“And of the view that by law, the two-count charges of culpable homicide punishable with death under section 191 (a) and (b) under Penal Code Law, 2021 have been proved and the offense has been committed by the defendant charged before this court.

“Based on the offense of culpable homicide punishable with death against Idris, I hereby convict you for committing the offense of culpable homicide punishable with death.

“Having regards to the plea of tempering justice with mercy to the accused persons made by his defense counsel, I hereby make the following sentence.

“That you, Idris, hereby sentenced to death by hanging and that you shall be hanged by the neck until you are dead.

In her Earlier, submission the Lead Prosecution Counsel, Zainab Mohammad Jabbo, told the court that the defendant committed the offense of macheting the woman to death and hitting the little girl’s head on the tiles in her mother’s room which led to her death on April 11.

She said the section under which the offenses were committed was non-negotiable, therefore, prayed the court to convict the accused as contained in the section.

While in his submission, the Defence Counsel, Alhassan salihu-Mohammad, prayed the court to temper justice with mercy in sentencing the accused person in sentencing him as he showed remorse for his action.

However, the husband of the deceased, Malam Akilu Aliyu, who expressed his delight over the judgment, appealed to the state government to speed up in execution the judgment. he pleaded.
